בתנ“ך נאמר “הילכו שניים יחדיו בלתי עם נועדו? הישאג אריה ביער וטרף אין לו? הייתן כפיר קולו ממעונתו בלתי אם–לכד?” (עמוס ג‘), והפירוש: אפשר להניח שכששני אנשים הולכים ביחד ובדרך משותפת, הם מתואמים ביניהם, ויש לכך סיבה. הפגיעה במעמדו הציבורי של נוה, ובשמו הטוב, מאלצים את שקד להתנער ממנו ולהבדיל את עצמה ממנו. היא צריכה להסביר לציבור שהיא הלכה עמו יחדיו עד היום, אבל זה לא אומר שצריך לזהות ביניהם. שהיא לא ידעה ולא יכולה הייתה לדעת על מה שלכאורה הוא עשה.
מוקדם יותר היום שקד החלה במסע ההתנערות הזה מחוצנו של נוה כשאמרה: “זה יום סוער עבורי, כשרת משפטים וכאישה“. וניכר על שקד שהיא דוברת אמת.

צר לי מאוד, אבל השאלה אם “יכול להיות” דבר כזה–וכזה, אינה תלוייה בחקירה המסויימת המתנהלת כעת.

“סמוכות ובטוחות כי מערכת אכיפת החוק תמצה את חקירת הפרשה ותגיע לחקר האמת. עוד ראינו לציין כי במהלך תקופת כהונתה של שרת המשפטים, חברת הכנסת איילת שקד, כיושבת–ראש הוועדה לבחירת שופטים, מינתה הוועדה 334 שופטים ורשמים בכירים בהליך מיון ובחירה קפדני ומקצועי. […]“.
מי שעוקב אחרי פרסומי הוולב“ש (המתחייבים על פי נהלי הוועדה עצמה), יודע כל על כל מינוי מתחרים 20, 30 מועמדים, ויותר, ואם נניח כי חלק מהמועמדים שלא נבחרו חוזרים שוב ושוב לרשימת המועמדים, אפשר לומר בוודאות מלאה כי על 334 המינויים האלה התחרו לפחות 2000 מועמדים.
הליך מינוי “מקצועי“, “קפדני” ו“יסודי“
כיצד אפשר לקיים הליך מינוי “מקצועי“, “קפדני” ו“יסודי“, כאשר קיימים אלפי מועמדים? תשובה ברורה יש בסע’ 4, 5, 9 ו-11א’ לכללי השפיטה (סדרי העבודה של הועדה לבחירת שופטים), תשמ“ד-1984, אשר זה לשונם:
4. ועדת הבחירה תבחר מבין חבריה ועדת משנה אחת או יותר שחבריה שלושה או יותר, ובה לפחות אחד מאלה: שופט בית המשפט העליון שישמש יושב ראש הועדה, חבר הכנסת ונציג לשכת עורכי הדין; נכלל יותר משופט אחד בועדה יכהן הבכיר ביניהם כיושב ראש הועדה.
5. (א) ראה המנהל כי נתקיימו במבקש תנאי הכשירות הקבועים בחוק, יזמן את המבקש להופיע לפני ועדת המשנה.
(ב) ועדת המשנה רשאית לשוב ולזמן את המבקש להופיע לפניה כל אימת שתמצא זאת לנכון.
9. על המועמדים יחולו ההוראות הבאות:
(1) …;
(2) המנהל יזמן את המבקש להופיע לפני ועדת המשנה – אם טרם הופיע לפניה … – שבועיים לפחות לפני מועד ישיבת ועדת הבחירה;
(3) …;
(4) בישיבת ועדת הבחירה ישמיע יושב ראש ועדת המשנה את חוות דעתה של ועדת המשנה על המועמד, ואם יושב ראש ועדת המשנה שוב אינו חבר ועדת הבחירה יקרא יושב ראש ועדת הבחירה את חוות דעתה של ועדת המשנה;
(5)
(א) יושב ראש ועדת הבחירה ימסור לחברי ועדת הבחירה 10 ימים לפחות לפני מועד ישיבת ועדת הבחירה את חוות הדעת על המועמד שלוקטו בידו או מטעמו שעובר לישיבה, ובהן דעתם של נשיא בית המשפט המחוזי ונשיא בית משפט השלום במחוז מגוריו של מועמד, וכן דעתם של שופטים אחרים, של הועד המחוזי של לשכת עורכי הדין במחוז האמור ושל כל גורם אחר שהמנהל ראה לנכון לבקש את חוות דעתו או שהמועמד ציין אותו בבקשתו וכן מידע רלוונטי שנתקבל על פי פסקת משנה (ב) וסעיפים 11 ו-11ב(ב);
(ב) היה המועמד עובד המדינה או עובד השירות הציבורי, יבקש המנהל את חוות דעתם של היועץ המשפטי לממשלה, פרקליט המדינה או המנהל הכללי של משרד המשפטים.
11א. התכונות העיקריות הנבדקות והנשקלות לגבי מועמד, ואשר לגביהן מתבקשת גם תגובת מחווי הדעת לפי סעיף 9(5), הן אלה:
(1) ידע ומיומנות בתחום המשפט כולל בקיאות משפטית, רב–גוניות בתחומי המשפט השונים, תפיסה משפטית, יסודיות בהכנת החומר המשפטי;
(2) כושר הבעה וניסוח בכתב ובעל–פה;
(3) יעילות וכושר ביצוע, לרבות כושר ארגון וניהול, סדר בעבודה, דייקנות, כולל עמידה בלוח זמנים, חריצות, גישה עניינית ותכליתית לעבודה, יעילות והספק בעבודה;
(4) סמכותיות וכושר לנהל דיון, כושר החלטה והכרעה, ישוב הדעת, הבחנה בין עיקר לבין טפל, התחשבות בכל הנתונים, והיכולת להגיע להחלטות נכונות;
(5) מזג שיפוטי המתבטא, בין היתר, בסבלנות, בסובלנות, בפתיחות ואופי יציב; שקט נפשי, יכולת עמידה בלחצים, יכולת ליצירת קשר עם אנשים; גינוני משפט;
(6) אינטגריטי, יושר אינטלקטואלי, הגינות כלפי הזולת, אמות מידה מוסריות, עצמאות בחשיבה ואי–תלות;
(7) חוכמה ותבונה;
(8) תדמית המועמד בעיני הזולת בתחום המקצועי ובחיי היומיום;
(9) מוטיבציה.
הנה כי כן, עד שעניינו של מועמד מגיע אל שולחנה של מליאת הוולב“ש (תשעה חברים), הוא עובר בוועדת משנה של שלושה חברים לפחות, וכן נשמעת דעתם של (1) נשיא בית המשפט המחוזי, (2) נשיא בית משפט השלום במחוז מגוריו, (3) שופטים אחרים, (4) של הועד המחוזי של לשכת עורכי הדין במחוז האמור וכן (5) אחרים, ואם המועמד הוא עובד המדינה או עובד השירות הציבורי, גם היועץ המשפטי לממשלה, פרקליט המדינה או המנהל הכללי של משרד המשפטים.
ואם לא די בכך, הוולב“ש, כאמור, מפרסמת לציבור הרחב את שמות המועמדים, על מנת שכל אדם יוכל להביע את דעתו על כל מועמד ומועמד.
אבל זה לא רק מספר האנשים שדעתם נשמעת, אלא גם הפרמטרים הרלוואנטיים, לפי סע’ 11א’, המחולק ל-9 קבוצות, ומונה כ-40 פרמטרים שונים.
הנה כי כן, הליך מינוי “מקצועי“, “קפדני” ו“יסודי“, צריך להתייחס ולתת ניקוד ל-40 פרמטרים, מוכפל במספר המועמדים, ואם נאמר כי מדובר ב-2000 מועמדים, הרי שיש לנו 80 אלף (!) ניקודים, אותם ניתן לשקלל לפי שהוועדה מוצאת לנכון, ולהכניס הכל לגיליון אקסל, או כל תכנה משקללת אחרת.
בדרך הזה אפשר לדרג את כל המועמדים, בצורה הכי מדעית שאפשר. אפשר, אם רוצים, לתת העדפה מתקנת במידת מה, ובלבד שהקריטריונים היו גלויים לציבור. כך, למשל, אם יתחרו מועמד יהודי עם ציון משוקלל 90%, ומועמדת צ’רקסית עם ציון משוקלל 89%, אני בהחלט הייתי נותן לצ’רקסית 2 נקודות נוספות, כאות הוקרה על תרומתה של העדה הצ’רקסית למדינה ולבטחונה (ואם טעיתי – זה בהחלט יכול להיות – הציבור כבר ישפד אותי, וזו זכותו).
להוסיף ניקוד לשופטת מסויימת
כעת, כאשר כל התהליך הזה מתנהל באופן “מקצועי“, “קפדני” ו“יסודי“, אם נציג של הלשכה, של השופטים או של הפוליטיקאים בוועדת המשנה, ובהמשך גם במליאת הוועדה, דורש להוסיף 20% למועמדת פלונית, זה צריך להדליק אור אדום אצל יו“ר הוולב“ש – שרת המשפטים איילת הכושלת, ואצל נשיאת ביהמ“ש העליון, אשר הייתה שותפה לשרת המשפטים בהודעה הנ“ל.
האם הליכי המינוי אצל הכושלת הם אכן “מקצועיים“, “קפדניים” ו“יסודיים“, עד כדי כך?
האם ניתן לומר איזה ציון נתנה הוולב“ש למועמד זה וזה בנושא רב–גוניות בתחומי המשפט השונים, כושר הבעה וניסוח בעל–פה, חריצות, ישוב הדעת, סובלנות, אינטגריטי, אמות מידה מוסריות, חוכמה ותבונה, תדמיתו בעיני הזולת בתחום המקצועי, תדמיתו בחיי היומיום, וכו’ וכו’ (לקחתי דגימת אקראי מתוך סע’ 11א’).
אני בטוח שלא.
יחד עם זאת, אם טעיתי, והוועדה אכן בוחנת ומנקדת את כל התכונות, ואם נבחן את איכותם של השופטים שהוועדה בוחרת אכן בחינה יסודית ומדוקדקת, כנטען – הרי זה כשלון טוטאלי, העובר מדור דור.
טלו, למשל, את היושר האינטלקטואלי (אחת משש התכונות המנויות בסע’ 11א(6)): אני מעריך שבשלושים שנות עריכת דין פעילה נתקלתי לפחות ב-300 – 400 שופטים, מהם 47 שופטים של ביהמ“ש העליון (ספרתי לפי הרשימה בויקיפדיה).
הוסיפו לכך שופטים שלמדתי את “פועלם” מפסיקתם וכו’ – ונגיע למספר עצום ורב.
אם הייתי צריך לתת ציון כללי למערכת המשפט בנושא היושר האינטלקטואלי, היינו מגיעים למשהו השואף–לאפס.
